These Terms of Service shall apply to your use of the service that enables users to easily change their physical address listed in their service providers provided by Monadd ltd. (“Monadd”, and such services, the “Service”). These Terms of Service represent the parties’ entire understanding regarding the Service and shall control over any different or additional terms of any purchase order or other non-Monadd ordering document.
We only permit individuals who are at least 13 years old and can form legally binding contracts with us to use the service, or provide any personal information to Monadd, or otherwise submit personal information through the service. Your use of the services means you represent and warrant that you meet all eligibility requirements we outline in these terms, so please provide accurate information about yourself. Monadd may still refuse to let certain people access or use the service. Monadd may also change its eligibility criteria. Further, we offer the service only for personal use, and not for the use or benefit of any third party.
You have to be at least 13 years old. No exceptions. Use Monadd as much as you want, but you’re not allowed to resell the service purchased, or other information obtained, through the website.
If you create an account, be responsible and keep the login information secret. You’re responsible for anything that happens using your account.
Registration and breach of service
When you create an account with Monadd, you must provide Monadd information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms of Service, which may result in immediate termination of your account on the Service.
You will not, and will not permit or authorize third parties to
rent, lease or otherwise permitting third parties to use the Service;
use the Service to provide services to third parties (e.g., as a service bureau);
breach, circumvent, tamper with or disable any security or other technological features or measures of the Service;
attempt to probe, scan or test the vulnerability of any systems related to the Service, including penetration or load tests; or
attempt to discover the underlying structure, technology or algorithms of the Service. The Service and any related software is subject to applicable export control laws and regulations. You agree to comply strictly with all such laws and regulations as they relate to the Service and such software, and, to the extent consistent with this Agreement, to obtain any necessary license or other authorization to export, reexport, or transfer the Service or such software when required.
You agree to use the Service in compliance with all other applicable laws and to indemnify and hold Monadd and its affiliates and their officers, employees, directors and agents harmless from any from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims and actions of any kind arising out of or relating to your use of the Service or your violation of these Terms of Service.
You will not have any rights to the Service except as expressly granted in this Agreement. Monadd reserves to itself all rights to the Service not expressly granted to you in accordance with these Terms of Service.
Access to service
User conduct and use of services
The Services are for your personal use, only, except where otherwise expressly provided. The products, services, software and information obtained from the Services may not be sold, transferred, licensed, reproduced, displayed, published, distributed, copied, performed or modified by you, or used to create derivative works.
You agree to use the Services only to change your physical address listed in your service providers and material that are proper and, when applicable, related to the particular Service. As examples of improper use, you agree not to:
Harass, stalk, defame, abuse, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Post, upload or disseminate any obscene, indecent, profane, defamatory or other inappropriate or illegal material.
Use the Services in connection with surveys, contests, raffles, games, “pyramid schemes,” chain letters, junk email, spamming or any duplicative or unsolicited messages.
Collect or store personally identifying information about other users for commercial or unlawful purposes.
Make any sexual request on behalf of or to a minor or harm minors in any other way.
Employ misleading addresses or false information.
Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including without limitation copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary approvals.
Use any material or information, including without limitation images or photographs, which are made available through the Services in any manner that infringes anyone’s proprietary right.
Upload, post, e-mail or otherwise transmit files that contain so-called viruses, Trojan horses, worms, time bombs, trap doors, corrupted files, or any other similar software or programs that may damage the operation of anyone’s computer or property or adversely affect the quality, performance or functionality of the Services.
Advertise or offer to sell or buy any goods or services for any business purpose, unless such Services specifically allow such messages.
Inhibit or restrict any other user from using and enjoying the Services.
Delete or falsify any copyright information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Download any file posted by another user of a Service that you know, or reasonably should know, may not be legally reproduced, displayed, performed, or distributed in such manner.
Violate any code of conduct or other guidelines which may apply to any particular Service.
Collect information about others, including e-mail addresses.
Use, download or otherwise copy, or provide (whether or not for a fee) to anyone any directory of users of the Services or other user or usage information.
Decompile, disassemble, modify, translate, adapt, reverse engineer, create derivative works from or sublicense any software employed in connection with Services.
Monadd is not required to monitor the Services. However, Monadd reserves the right to review and remove materials posted to the Services in its sole discretion.
In its sole discretion, Monadd may disclose any information it deems necessary or appropriate to satisfy any applicable law, regulation, legal process or governmental request, or refuse to post, remove or edit any materials, in whole or in part.
However, we will use the information provided in the registration process for the purposes of maintaining your registration only, which may include, without limitation, invoicing and billing, notifying you of availability of and changes to your access to Monadd, Website. Your registration information will not be disclosed to any third parties, except as may be required for enforcement of this Agreement, or as otherwise permitted or required by applicable law.
We may collect and store personal identifiable information about you when you visit the Site (“Personal Data”). This information may include, but is not limited to, details such as your name, address, telephone number, fax number, URL, domain name, I.P. address, company name, job title or email address. We may use this information to contact you or your company about various products and information’s from time to time. We may also collect and store information about you to improve the Site and improve user interaction based on the information collected.
This Monadd Agreement - T&C's is a contract between you and Monadd, Monadd Ltd is a company registered in United Kingdom. With Company registration no. 11471322, having its registered office at Office address at 13 Hawley Crescent. Work.Life. London, UK NW1 8NP, branded as Monadd ("WE"), and covers all Monadd made pursuant to this Website.
Our website is hosted in England. They provide us with the online website that allows us to sell our services and products to you.
Accuracy and information disclaimer
This Site, its service, the contents displayed on it and any information, data, view or opinions provided by Monadd on the Site provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
We use reasonable efforts to ensure the accuracy, correctness and reliability of the content of the Site, but we make no representations or warranties as to the accuracy, correctness or reliability of any content. By accessing and using the Site, you acknowledge that your use of the Site and any reliance which you place on any information, data, views or opinions obtained from the Site will be entirely at your own risk. We accept no liability for any errors or omissions on the Site. We cannot guarantee that any colour displayed on your monitor is correct as computer monitors vary. Please email email@example.com.
Fees. Monadd offers fee-based Monadd Services that provide additional features and functionality. Pricing and services for paid accounts are described on Monadd’s Services pricing page and may be updated from time to time. If you sign up for a paid account, you agree to pay Monadd all applicable fees for the tier of Monadd Services according to your selection. Fees are non-refundable except as required by law or as otherwise specifically permitted in this Agreement.
A valid credit card is required to access our service. There will be no refunds or of service, upgrade/downgrade refunds, or refunds for unused months with an active account.
Taxes. Fees are exclusive of taxes, duties, levies, tariffs, and other governmental charges (collectively, “Taxes”), and Customer is responsible for all Taxes resulting from this Agreement or Customer’s use of the Monadd Services. Monadd will invoice Customer for Taxes when required to do so by applicable law, and Customer agrees to provide payment under the terms of the invoice. In the event Customer is required by law to deduct and withhold any Taxes on amounts payable under this Agreement, any amounts required to be withheld will be promptly deducted and timely remitted by the Customer on behalf of Monadd to the appropriate taxation authority and Customer agrees that it will provide Monadd with copies of all necessary documents (including but not limited to tax receipts received from the applicable tax authority) in order for Monadd to claim and receive a foreign tax credit in an amount corresponding to the amount withheld by the Customer.
DMCA Copyright Policy
Here’s what happens if somebody thinks something infringing is posted to the Site or Services. In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users of the Service who are deemed to be repeat infringers
In accordance with the Digital Millennium Copyright Act (the “DMCA”), Monadd has adopted the following policy toward copyright infringement on the Services. If we believe a user may be infringing upon someone’s intellectual property rights, we may remove the material. If we believe someone is repeatedly infringing, we will terminate that person’s access rights. If you believe someone has posted on the Services a work that you own without your authorization, please send a notice of copyright infringement containing the following to our Designated Agent (whose contact information is below): Monadd may also at its sole discretion limit access to the Service and/or terminate the Profiles of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Identification of works or materials being infringed;
Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that we are capable of finding and verifying its existence;
Your contact information, including address, telephone number and, if available, e-mail address;
A statement that you have a good faith belief that the material is not authorized by the copyright owner, its agent, or the law;
A statement made under penalty of perjury that the information provided is accurate and you are authorized to make the complaint on behalf of the copyright owner; and
A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringe.

GDPR Data Protection Agreement
We each have our respective obligations to relevant government authorities and to individuals whose personal data we process to comply with applicable data protection laws. Where the European Union (“EU”) General Data Protection Regulation (“GDPR”) and national implementing legislation apply in relation to any personal data that you provide to us, in the instance of Proprietary Targeting & Insight Services we each act as a controller in our own right in regard to our respective processing of the personal data. Our EU Privacy Notice describes the processing activities of our EU offices as controllers of the personal data of our Clients, individuals connected to our Clients and other business contacts, in accordance with GDPR requirements. In fulfilling our duties to relevant government authorities and individuals under applicable law our EU offices will process personal data that you share with us, or that we obtain from other sources on your behalf, only for the relevant purposes that are set out in our EU Privacy Notice or any supplemental notice that we may provide to you in connection with a particular matter.
You may also have obligations under the GDPR and you will reasonably cooperate with us with respect to any personal data that are shared between us, in order to facilitate our compliance with the relevant provisions of the GDPR. including (without limitation) by: (A) transferring the personal data to us only as necessary for us to provide the services for which you have engaged us; (B) having a lawful basis for disclosing the personal data to us; (C) providing all the information required to be provided by the GDPR, in the applicable circumstances, (including, where possible, a link to the EU Privacy Notice published on our website [ and (D) assuming the primary responsibility for responding to data subject access requests in relation to personal data that you have shared with us.
We will cooperate with you when reasonably possible to ensure that the required information referred to above is made accessible to the relevant individuals; and we will meet our own obligations to provide information directly to the individuals concerned, such as any industry schemes that we may use (for example, IAB consent tool) to address setting of cookies on users’ devices and collection of personal data and further processing of user data, if required.
The description of our respective obligations under applicable data protection laws in this Agreement covers our respective obligations to relevant government authorities and to individuals whose personal data we process but does not create new duties or obligations between us by virtue of this data protection clause (except as explicitly stated concerning cooperation and our respective roles as controllers of personal data).
Software available on this web site
Any software that is made available from the Services ("Monadd Software") is the work of Monadd and/or its suppliers and is protected by copyright, trademark and other applicable laws. The end user license agreement, if any, which accompanies or is included with the Monadd Software (“Monadd End User License Agreement") governs its use. An end user will be unable to use any Monadd Software that is accompanied by or includes a Monadd End User License Agreement unless he or she first agrees to its terms.
The Software is made available solely for use by end users according to the terms of the License Agreement.
COPYING OR REPRODUCING MONADD SOFTWARE TO ANY OTHER LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED, UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED BY THE APPLICABLE MONADD END USER LICENSE AGREEMENT. VIOLATORS WILL BE PROSECUTED TO THE MAXIMUM EXTENT OF THE LAW.
MONADD MAY MAKE AVAILABLE AS PART OF THE SERVICES OR IN ITS MONADD SOFTWARE PRODUCTS, TOOLS AND UTILITIES FOR USE AND/OR DOWNLOAD. MONADD MAKES NO ASSURANCES AS TO THE ACCURACY OF THE RESULTS OR OUTPUT THAT DERIVES FROM SUCH USE OF ANY SUCH TOOLS AND UTILITIES.
EXCEPT AS MAY BE WARRANTED IN THE MONADD END USER LICENSE AGREEMENT, MONADD DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE MONADD SOFTWARE, INCLUDING WITHOUT LIMITATION ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, INFORMATIONAL CONTENT OR ACCURACY, QUIET ENJOYMENT, TITLE AND NON-INFRINGEMENT, WHETHER EXPRESS, IMPLIED OR STATUTORY.
THE SERVICE IS PROVIDED ON AN “AS-IS” BASIS AND MONADD DISCLAIMS ANY REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED (EITHER IN FACT OR BY OPERATION OF LAW), OR STATUTORY, AS TO ANY MATTER WHATSOEVER. MONADD EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, ACCURACY, TITLE, AND NON-INFRINGEMENT. MONADD DOES NOT WARRANT THAT THE SERVICE IS ERROR-FREE OR THAT OPERATION OF THE SERVICE WILL BE SECURE OR UNINTERRUPTED.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONADD, ITS AFFILIATES, DIRECTORS, EMPLOYEES OR ITS LICENSORS BE LIABLE FOR (A) ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR BUSINESS OR OTHER INTANGIBLE LOSSES, OR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICE OR TECHNOLOGY, (B) ANY MATTER BEYOND ITS REASONABLE CONTROL OR (C) ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU FOR THE SERVICE IN THE PRECEDING 12 MONTHS. WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES WILL MONADD BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION OR CONTENT CONTAINED THEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONADD ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. Intellectual Property & Trademark
Ownership. Except for any Customer Content or Customer Services, Customer acknowledges and agrees that Monadd is the sole and exclusive owner of all right, title and interest in and to the Monadd Services and Monadd Software and all related documentation, source code, tools, scripts, processes, techniques, methodologies, inventions, know-how, concepts, formatting, arrangements, visual attributes, ideas, database rights, copyrights, patents, trade secrets, and other intellectual property, and all derivatives, enhancements, modifications and improvements thereof (“Monadd Materials”). Nothing in this Agreement or any other document shall be deemed to transfer ownership of the Monadd Materials and all rights in such Monadd Materials are reserved.
Feedback. Customer is not required to provide any suggestions, enhancement requests, recommendations or other feedback regarding the Monadd Services or Monadd Software (“Feedback”). However, if Customer does so, all right, title and interest in and to such Feedback shall be assigned to, and shall become the sole and exclusive property of, Monadd upon its creation.
License Restrictions. Customer shall not share access credentials to exceed the user limitations of the service tier Customer has purchased. Customer and its Personnel shall not, and shall not permit any third party to: (i) access the Services or export data from the Services to create a service, software, documentation or data for other than Monadd or create a service that is competitive with, substantially similar or confusingly similar to any aspect of the Monadd Services or Monadd Software; (ii) use, modify, display, perform, copy, disclose or create derivative works of the Monadd Services except as expressly permitted herein; (iii) reverse engineer, decompile, disassemble, mimic, screen-scrape, frame or mirror the Monadd Services or Monadd Software, or use any other means to attempt to discover their source code except as expressly permitted herein; (iv) benchmark, encumber, distribute, sublicense, assign, share, sell, rent, lease, pledge or otherwise transfer the Monadd Services or Monadd Software to any third party; (v) transmit harmful, disabling or malicious code or devices, or infringing, defamatory, unlawful, tortious, deceptive, misleading, fraudulent, abusive, indecent or otherwise offensive content, or content that contains someone’s personal information or violates a third party’s intellectual property, privacy or publicity rights (“Prohibited Content”) through the Monadd Services; (vi) access via automated or unauthorized means, interfere with, disrupt or attempt to monitor, override access or circumvent security measures for, the Monadd Services or Monadd Software or related systems, including via robots, spiders and other electronic methods; and (vii) obscure, remove or alter any proprietary rights or other notices on the Monadd Services or Monadd Software. Notwithstanding anything to the contrary herein, Monadd may, in its sole discretion, immediately revoke the grant of rights set forth in Section 3 if Customer breaches or threatens to breach the restrictions in this Section or creates other security or legal concerns. Customer hereby agrees that Monadd will be entitled, in addition to any other remedies available to it at law or in equity, to injunctive relief to prevent the breach or threatened breach of Customer’s obligations under this Section, without any requirement to demonstrate irreparable harm or post a bond.
Trademarks. Monadd grants Customer a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Monadd’s names, logos, designs, and other trademarks incorporated into the Monadd Services (“Monadd Marks”) during the Term and solely for the purposes of displaying such notice as part of the Monadd Services.
You will fully indemnify and keep us indemnified against all losses and damages (including loss of profits, special, indirect, incidental or consequential loss or damage, loss of goodwill and any reasonable legal costs or sums paid in settlement of any claim or proceedings brought against us by a third party) arising due to any breach of these Terms (including a breach of any warranties) by you and also in the event of any claim or legal proceedings brought or threatened against us by a third party as a result of your actions.
Some of the cookies we use are essential for our Sites to function correctly - for example keeping track of items that have been added to your shopping basket or remembering you have logged in. Other cookies may be used to personalize your online experience, track your journey through our Site (so that we can maximize your experience and help us understand how we can improve it) or analyses the success of promotions. Monadd does not control or endorse any User Content or third party content, and we make no claims or representations regarding any content we do not create. We may provide links to third party sites or resources, but these links do not mean we endorse or have any associations with the third parties. Please note that any moderators, forum managers or hosts on the Services are not authorized as our spokespersons, and their views do not necessarily reflect those of Monadd. If any damage or loss results from your use of, reliance on, or any other connection between you and any content that any third party makes available, you acknowledge and agree that we are not responsible or liable, directly or indirectly. We take no responsibility related to third party content, User Content, or any actions resulting from your use of any part of the Services. Monadd will have no liability in connection with any content submitted to, transmitted via, or displayed or posted on or through the Services, regardless of whether Monadd or another party provides it.
We can’t take responsibility for the whole internet. If you access third party Websites, we’re not the ones responsible.
Safeguards for customers in the EEA/EU area
You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and Monadd as a result of the Terms or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of Monadd, and we shall not be liable for any representation, act, or omission on your part.
Every effort is made to ensure the continuity of the Site, but some occasional technical downtime beyond our control may occur. Such downtime may prevent you from accessing the Information on the Site for the duration of the down time. We shall not be liable if your access to the Information via the Site is delayed or prevented by any cause beyond our control including, for the avoidance of doubt, hosting server downtime.
Entire Agreement and Severability. These Terms of Service are the entire agreement between you and Monadd with respect to the Services and supersede all prior or contemporaneous communications and proposals (whether oral, written or electronic) with respect to the Services. Further, if any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary. The limitation or elimination of the term will not affect other terms. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder
Force Majeure. Sometimes things come up that are outside of our control. Because of that, we shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.
Assignment. These Terms of Service are personal to you. You cannot assign, transfer, or sublicense these Terms without first obtaining our consent. We may assign, transfer or delegate any of our rights and obligations hereunder without consent.
No Waiver. Our failure to enforce any part of these Terms of Service shall not constitute a waiver of our right to later enforce that or any other part of these Terms of Service. Waiver of compliance in any particular instance does not mean that we will waive compliance in the future. In order for any waiver of compliance with these Terms of Service to be binding, we must provide you with written notice of such waiver through one of our authorized representatives.
We may terminate any contract between Monadd and you (including any license granted under these Terms), or terminate your registration and invalidate your Login at any time upon notice in writing (which may be by email) to you in the event of:
any breach by you of these Terms including the failure to pay any amount due under an order or mis-use of the Site or
